We would therefore like to inform you hereof of the methods we will apply to the processing of your personal data, which will be collected when you use our sites and applications or when you interact with our operators (hereinafter collectively referred to as the "Platforms").

In particular, we have to process the data that you have provided to us at the time of registration or when requesting a service. With your consent, we may also use other information that you freely provide to us when registering or relating to the ways in which you interact with us (collectively, the "Data"). 

This Privacy Statement (and our Terms and Conditions applicable to the respective services, our Cookie Information and other information that may be provided in relation to each service) sets out the conditions that will apply to the processing of your Data.

1. What Data will we use?

We may collect and process the following Data:

1.1. Data collected through the application or registration form

In order to request a quote or a test drive of a car and to use other services that require your prior registration, we may ask you to provide us with some personal data concerning you such as your identification data (first and last name) and your contact details (e.g. postcode, telephone, e-mail) and data relating to the car for which you are requesting a certain service (e.g. vehicle registration, mileage).

The communication of the requested data by means of the corresponding form is optional; However, if you do not provide us with the data marked with an asterisk, we will not be able to complete the registration process and/or provide you with the requested services.

With your consent, we may also use other information that you have freely provided to us on the form, such as date of birth, driver's license number and expiry date, gender, tax identification code, profession and educational degree.

1.2. Data collected from social media

Our Platforms may give you the opportunity to complete application and/or registration forms using the authentication process via social media (e.g. Facebook).

In this case, and whenever you choose to use the social media authentication method, we may access certain data (e.g. first name, last name, public profile picture and email address) that you have entered into your account, in accordance with the terms of use of such social media platforms and their privacy settings.

1.3. Data collected through the use of the Platforms

During the use of our Platforms, we will process the Data necessary to ensure the use of our Platforms and their respective services, such as, for example, data relating to the login and pages visited and your requests, preferences for a certain car (also indicated through the corresponding function of our app), detailed data sheets of the cars examined, the comparison between cars and other additional information that you have freely provided to us to aesthetically complete the experience on our Platforms (such as personal profile picture and photo of each vehicle).

In the absence of specific consent for processing for other purposes, this information will be used only to consent to the use of the Platforms and to provide the information and services requested.

1.4. Browsing data

Even if you do not log in, the computer systems used to ensure the proper functioning of our sites and applications acquire, during their normal operation, some personal data, the transmission of which is implicit for the purposes of the use of electronic communication systems.

Such information is not collected in order to be associated with identified data subjects, but, by its very nature, it could allow its identification through processing and association with data held by third parties. This category includes, for example, the IP addresses or domain names of the computers you use to access our sites and apps, browser type and version, browser plug-in types and versions, mobile device identification information (IDFA or AndroidID) and other parameters relating to your operating system and IT environment, the URI (Uniform Resource Identifier) of the requested resources, the time of the request, the size of the file obtained as a response, and the numerical code that indicates the status of the server's response.

In the absence of specific consent for processing for other purposes, this data will only be used to collect anonymous statistical information on the use of the sites and applications and to optimize use and correct functioning, and will be deleted immediately after processing.

1.5. Other data

With your consent, we may also use other information that you have freely provided to us when filling in the application and/or registration form or when using the Platforms, as well as other information regarding the ways in which you interact with us and our operators and sales consultants.

For what purposes will we use your Data and on what legal grounds?

We will use your Data, including using electronic instruments:

1.       To enable you to use our Platforms. Your Data will be used to provide you with the related services provided for you and, more broadly, to satisfy all related contractual and administrative obligations.

2.       To provide you with the requested quotes and/or test drives.

3.       To comply with legal obligations or to comply with any provisions of the judicial authorities.

4.       For statistical purposes, in a completely anonymous and aggregated form.

With your consent, we may also use your Data for the following purposes:

1.       To send you commercial and/or promotional information and advertising material or to carry out direct sales activities or interactive commercial communications about products, services and other activities of the DEALER or third parties or to carry out market research. We may, for example, send you e-mails or instant messages (e.g. SMS and WhatsApp), or contact you by telephone through an operator to inform you of commercial offers, initiatives and promotions relating to products and services (even different from those you have requested) from us and/or third parties.

2.       To examine your preferences and the ways in which you interact with us. In particular, in order to better understand your preferences and interest in our services and communications, we may examine – including through the use of automated systems – the information you have provided when registering for the Platforms and other services provided on the Platforms, your interest in the communications and e-newsletters we will send you, how you use our Platforms and your interest in our social channels (e.g. Facebook). Finally, we may supplement your profile with statistical information that we may lawfully acquire from other sources, such as data relating to your area of residence (such as demographic information, geo-referrer data, etc.) or the electronic tools you use to interact with us.

Under no circumstances will it be subject to automated decision-making processes with the effects referred to in Art. 22 GDPR.

1.       to disclose your Data to our Business Partners for independent marketing purposes.

The use of the Platforms and the enjoyment of the respective services, including the response to requests for quotes and test drives, are in no way subject to the provision of the aforementioned consents.

3. How long will we keep your Data?

Your Data will be processed for the time necessary to provide you with the requested services. In the event that you have not given your consent for the processing for other purposes, your Data will be deleted or anonymized 12 months after the date of receipt of your request.

The information associated with your account on the Platforms, on the other hand, will be stored for as long as the account remains active. In case you decide to cancel your account, you will be removed from the account within a maximum period of 30 days. In any case – for the purposes mentioned in point 2, letters (e) and (f) – the information relating to the details of the services you use and your interactions with us will be processed for a maximum period of 12 months following the date of collection.

4. To whom will we disclose your Data?

For administrative purposes, your Data may be shared with parents, subordinates and associates of the DEALER and, for the purposes of the administration of the Platforms and for the provision of the requested services, with our providers of services instrumental to the services provided by the DEALER (e.g. IT services). Such subjects shall operate in their capacity as data processors.

In the event of a request for a quote or test drive, your Data may also be communicated by DEALER to our business partners, whose cooperation is necessary to provide the requested services and, in particular, financial companies or insurance companies and car manufacturers or companies delegated by them for the management of the contacts involved in each case (hereinafter referred to as the "Business Partners") on the basis of the quotation and/or test drive requests you send to us.

Our Business Partners operate as independent data controllers and in compliance with the respective privacy statements, which they themselves will send you together with the quotes or information requested.

We will make available to you a complete list of the subjects to whom we may disclose your Data by sending a written request to the contacts listed below.

5. Will your Data be transferred to non-EU countries?

Your Data will not be transferred outside the territory of the European Union.

6. What rights can you exercise?

You have the right to request access to the data, rectification or cancellation of the data, restriction of processing, to object to its use by us and to demand the delivery of some of the data.

The data subject has the right to obtain confirmation from the controller that there is or is not an ongoing processing of personal data concerning him or her and, if so, to obtain access to the personal data and to the following information:

g) In the event that the data are not collected from the interested party, all available information on its origin.

(h) The existence of an automated decision-making process, including profiling, which produces legal effects concerning him or her or which significantly affect him or her in a similar way and, at least in such cases, meaningful information on the logic applied and the importance and expected consequences of such processing for the data subject.

 Right to rectification

The data subject has the right to obtain from the controller the rectification of inaccurate personal data concerning him/her, without undue delay.

 Right of cancellation

The data subject has the right to obtain from the controller the erasure of personal data concerning him/her, without undue delay, and the controller has the obligation to erase the personal data without undue delay, if any of the following reasons exist:

a) The personal data is no longer necessary for the purposes for which it was collected or otherwise processed.

b) The data subject revokes the consent on which the processing is based and there is no other legal basis for the processing.

c) The data subject objects to the processing and there is no overriding legitimate reason for the processing.

d) The personal data was processed unlawfully.

e) Personal data must be erased in order to comply with a legal obligation provided for by European Union law or by the law of the member country to which the controller is subject.

 Rights to restriction of processing

The data subject has the right to obtain from the data controller the restriction of processing when any of the following circumstances occur:

a) If the data subject contests the accuracy of the personal data, for the period necessary for the controller to verify the accuracy of such personal data.

b) If the processing is unlawful and the data subject opposes the erasure of the personal data and requests, instead, that its use be restricted.

c) If, even if the controller no longer needs the personal data for the purposes of the processing, they are necessary for the data subject for the establishment, exercise or defence of a right before the judicial authorities.

d) If the data subject objected to the processing, pending verification of the possible predominance of the legitimate grounds of the controller over those of the data subject.

 Right to object

The data subject has the right to object at any time to the processing of personal data concerning him or her on the basis of the legitimate interest of the controller, including profiling. The data subject has the right to object at any time to the processing of personal data concerning him or her for direct marketing purposes, including profiling, insofar as it is related to such direct marketing purposes.
