• Purpose : your data will only be processed to (i) register you and manage your user profile on the platform; (ii) provide the assistance services provided on the platform that you may need; (iii) manage and respond to the queries that you send us through any of the contact means and (iv) manage the claims that you could file.

This is the Privacy Policy of the FLIT2go platform (hereinafter, the “ Platform ”) managed by SMART MOBILITY SERVICES SPAIN, SL (hereinafter, “ SMS ”).

SMSS reserves the right to modify or adapt this Privacy Policy at any time. Therefore, we recommend that you review it each time you access the Platform.

I. Who is the Data Controller?

The data that is collected or that you provide us voluntarily through the Platform -whether by making use of it as the owner of vehicles or their lessee- as well as all those that you can provide us in the contact forms, via email or by telephone, will be collected and processed by the Treatment Manager, whose data is indicated below:

For information purposes, it is recalled that vehicle owners will be responsible for the personal data of driver users for any relationship maintained with them, both in relation to the use of the vehicle and possible claims.

II. What data do we collect through the Platform?

Data collected during the registration process as a user and subsequent use of the Platform

When you register and use the Platform, the following may be collected:

• Name and surname.
• Date of birth.
• DNI (of the driver user or the representative of the company registered as owner).
• Driver's license.
• Photo provided to verify the identity of the user with the DNI and card provided.
• Phone number.
• Contact postal address in the event of notifications and claims.
• Contact email for the case of notifications and claims.
• Exclusively in the event that an Owner has contracted the additional Fleet Control module in the Platform (Control), he/she will have access to the geopositioning data and vehicle sensors at any time, under his/her sole responsibility, being the Owner considered responsible for the processing of personal data that may be collected through the aforementioned Fleet Control module for the purposes of the provisions of the applicable personal data protection regulations and must inform the Driver of any use made of the same.

The legality of the treatment of the data that you provide us in the registration process is the execution of the contract that represents the Terms of Use of the Platform that you accept to be able to use it and the acceptance of this Privacy Policy.

Data collected during the payment process through the platform

As a result of the process of making any payment through the platform, the following data is collected:

• Payment method (credit card) -> Collected and stored by Stripe guaranteeing the security and compliance of data security for this purpose.
• Phone number -> Collected and stored by Stripe guaranteeing the security and compliance of data security for this purpose.
• Information of the installed application -> Collected and stored by Stripe guaranteeing the security and compliance of data security for this purpose.

This information will only be used to make the different payments necessary in the rental process, managed directly by Stripe (Stripe SDK) .

Data provided in the contact form

You can contact us directly through the “Contact ” section located on the Platform. For this, it is necessary that you identify yourself and indicate your personal data, so that SMSS can contact you, if necessary, to attend to your request for information. The necessary and mandatory data to be provided by the user to carry out such registration, are marked with the symbol *. In the case of not providing such fields, the sending of your request will not be allowed.

The legality of the treatment of the data that you provide us is your consent when sending the contact form accepting this Privacy Policy.

Data provided through an associated Rentacar website

There may be cases in which we can introduce the possibility that you can provide us with your data through the website of an owner with whom we have closed a collaboration agreement. When this possibility is feasible, you can transmit your personal data to the owner through its form on the web and in this way it is the owner who provides us with some of your data in our system (Flit2go). In this way it is possible that you receive an email indicating that the corresponding owner has invited you to our Flit2go platform and that for this purpose you download the App and enter your credentials to access it, proceed to finish the registration and finally to make the reservation you want at any time. 

For this purpose, and in an illustrative and non-limiting way (although it would be indicated at all times what data would be requested) the data that the user would provide on the associated Rentacar website would be:

• Name surname
• DNI (or ID Card nº, or Passport nº)
• Nationality
• Country of residence
• Full address of residence
• Date of birth
• E-mail.
• Driving license and number

 For this purpose, the corresponding express acceptance will be requested before proceeding with the shipment in order to comply with current regulations on data protection.

III. Purpose and use of personal data collected

SMSS will process the personal data collected to:

(i) register and manage your user profile on the platform;

(ii) provide the assistance services provided on the platform that you may need;

(iii) manage and respond to the queries that you send us through any of the means of contact and

(iv) manage the claims that you could file.

The personal data collected will be kept while you remain registered on the Platform and for thirty (30) days after you unsubscribe in the event that any other user or any third party files a claim against you, except for the personal data that are necessary to comply with the corresponding tax obligations, which will be kept for the period established by the applicable regulations. 

The personal data that you provide us will not be communicated to third parties other than those in charge with whom SMSS can contract the provision of any of the services provided on the platform (eg call center) and to the authorities that may correspond in accordance with the applicable regulations. .

SMSS will not make international transfers of your personal data.

IV. Use of cookies and the activity file

SMSS, on its own account or through a third party contracted to provide measurement services, may use cookies when a user uses the Platform.

What are they? Cookies are files sent to the browser through a web server in order to record the user's activities during their browsing time.

The cookies used on the Platform are only associated with an anonymous user and their computer, and do not themselves provide the user's personal data.

IP addresses

The Platform's servers may automatically detect the IP address and domain name used by the user. An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in a duly registered server activity file that allows the subsequent processing of the data in order to obtain only statistical measurements that allow knowing the number of page impressions, the number of visits made to web services, the order of visits, the access point, etc.

V. Veracity and accuracy of the data provided

The user must use true, exact, complete and updated data. The user will be solely responsible for any loss or damage, direct or indirect, that could be caused to SMSS or to any third party due to the use of false, inaccurate, incomplete or outdated data.
